બંધારણની રચનાનો સૌપ્રથમ વિચાર 1934માં માનવેન્દ્રનાથ રોયને આવ્યો. 1935માં INC એ પ્રથમ વખત બંધારણસભાની રચનાની માગણી કરી. 1935માં જવાહરલાલ નેહરુએ INC વતી બંધારણની માગણી કરી
જેમાં પુખ્ય વય મતાધિકારના ધોરણે બ્રાહ્મ દાખલ વગર બંધારણ સભાની માગણી કરી. જે 1940માં ‘ઓગસ્ટ ઓફર’ના સ્વરૂપે સ્વીકારવામાં આવી.
1942માં સ્ટેફર્ડ ક્રિપ્સના નેતૃત્વ હેઠળ ક્રિપ્સ મિશન ભારત આવ્યું પરંતુ તેની દરખાસ્તનો અસ્વીકાર કરવામાં આવ્યો.
અંતે, 1946માં કેબિનેટ મિશન ભારતમાં આવ્યું, જેમાં તરાન સભ્યો પેંથીક લોરેન્સ, એ.વી. એલેક્ઝેન્ડર, સ્ટેફર્ડ ક્રિપ્સ હતા. જેણે ‘બંધારણ સભા’ની યોજનાની જાહેરાત કરી.
બંધારણ સભાની કુલ સભ્ય સંખ્યા 389 રાખાઈ. જેમાં 296 બેઠક બ્રિટિશ ભારત અને 93 બેઠકો દેશી રજવાડાઓ માટે રાખવામાં આવી. (196 પૈકી 4 સભ્યો કમિશનર ક્ષેત્રોમાંથી હતા.)
એક બેઠક દસ લાખ અપ્રત્યક્ષ રીતે ભરવામાં આવી જયારે દેશી રજવાડાઓની બેઠકો નામાંકની ભરવામાં આવી.
આમ, જુલાઈ-ઓગસ્ટ, 1946માં ચુંટણી સંપન્ન થતા, બ્રિટિશ ભારતની 296 બેઠકો પૈકી કોંગ્રેસને 208, મુસ્લિમ લીગને 73 અને 15 બેઠકો અન્યોને પ્રાપ્ત થઇ હતી.
(296 બેઠકોમાં 12 મહિલા સદસ્ય હતા) અને મૌસુર સૌથી વધુ બેઠકો ધરાવતું રજવાડું (7) હતું.
